expressed, thoughts, opinions, oral or written, advice given, information, strategies,
and services provided are for educational and informational purposes only. The
coaching course does not guarantee any specific results or outcomes. Individual
results may vary and are dependent on a variety of factors. In no event shall Erika
Walton, or business entity, Destiny by Design be liable for any direct, indirect,
incidental, special, or consequential damages arising out of or in connection with the
coaching course or any information provided therein. We want to make it clear that

not a licensed therapist or counselor, nor does Erika Walton claim to be, and that the
program is not therapy or counseling.
You understand that the coach, Erika Walton, or business entity, Destiny by Design
will not diagnose or treat any mental or physical health conditions, nor does Erika
Walton claim to be, and that you should seek the advice of a licensed healthcare
professional for any medical or mental health concerns.
You understand and agree that the coach, Erika Walton, or business entity, Destiny by
Design is not liable for any losses, injuries, and damages resulting from your use of
the information, services provided, or participation in the Destiny by Design program,
including but not limited to, direct, indirect, incidental, consequential, or punitive

actions you take in resolving them are entirely at your own risk. You are solely

Destiny by Design and the coach Erika Walton, offers recreational activities as part of
its coaching course, but please be aware that participation in these activities is entirely
at your own risk, that you are responsible for your own safety and well-being. . We
want to make it clear, you also agree to release the business Destiny by Design and
the coach Erika Walton from any liability for any injuries or damage to property that
may arise as a result of your participation in these activities. We assume no liability
for any injuries or damage to yourself and property that may occur during these
activities, whether you are a member, guest, or participant.

all content, videos, training materials, products, services and/or other materials, made
available on the Site by us or other third parties, as well as the look and feel of all of
the foregoing, (collectively referred to as the “Content”) are maintained for your
personal use and information by Erika Walton, or business entity, Destiny by Design,
any associated parties, (the “Company”) and are the property of the Company and/or
its third party providers. You agree that such Company Content shall include all
proprietary videos, HTML/CSS, Javascript, graphics, voice, and sound recordings,
artwork, photos, documents, and text as well as all other materials included in the

  of Erika Walton and the business Destiny by Design. By enrolling in our
  coaching course/master class, you agree that you will not copy, reproduce,
  distribute, or share any of these materials without our prior written consent.
  You understand that any unauthorized use or distribution of these materials
  may result in legal action. Additionally, any strategies, techniques, or
  information shared during the coaching course are confidential and proprietary
  to Erika Walton and the business Destiny by Design. You agree to maintain the
  confidentiality of all such information and not to disclose it to any third party
  without our prior written consent.
5. All trade names, trademarks, and images and biographical information of
  people used in the Company Content and contained in the Site are either the
  property of, or used with permission by, the Company. The use of Content by
  you is strictly prohibited unless specifically permitted by these Terms of Use.Any unauthorized use of Content may violate the copyright, trademark, and
  other proprietary rights of the Company and/or third parties, as well as the laws

solely responsible for the use of any data and information obtained, and all
transaction requests electronically transmitted, by any person using your IDs and

Please note that all sales are final and non-refundable. By making a purchase, you acknowledge and agree that you will not be entitled to any refunds, regardless of the
reason for your dissatisfaction with the product or service. We stand behind the
quality of our coaching course and believe in providing our clients with the best
possible experience. However, we cannot guarantee specific results or outcomes from
participating in the coaching course, and therefore cannot offer refunds based on the

2. Confidentiality: We take confidentiality very seriously and want to ensure that
  any personal or private information shared during the coaching course is kept
  confidential. Erika Walton and Destiny by Design agree not to disclose any
  information or materials shared during the coaching course to any third party
  without the client's prior written consent, except where required by law. We
  will take all reasonable steps to maintain the confidentiality of all client
  information and materials. However, it's important to note that electronic
  communications, such as email, are not always secure, and there is a risk that
  information shared via these means could be intercepted by a third party. We
  recommend that clients exercise caution when sharing sensitive information via
  email or other electronic communication methods.
Communication policy: Our communication policy is designed to ensure clear and
effective communication between Erika Walton, Destiny by Design, and our coaching
clients. We will communicate via email, or video conference, as agreed upon by both
parties. Our response time to client inquiries is within 1-3 days, during business hours,
Wednesday through Saturday 10:00 AM - 4:00 PM Pacific Standard Time. We will make
every effort to communicate in a timely manner and provide support to our clients
throughout their coaching journey. For one-on-one coaching sessions, if a client is
unable to attend a scheduled coaching session, we require at least 24 hours' notice in
advance to reschedule the session. Failure to provide sufficient notice may result in
the forfeiture of the session. (*Please note that this policy applies only to one-on-one
coaching sessions. Group coaching sessions have a set schedule and cannot be
rescheduled for individual clients.) We value clear and honest communication, and
expect our clients to do the same. If any issues or concerns arise during the coaching
process, we encourage clients to bring them to our attention so that we can work
together to find a solution.
1. To ensure the best coaching experience for everyone, it's important that you
  come prepared to each weekly group zoom or individual coaching session,
  having done the suggested coaching work, and be on time. Please approach
  each session with an open mind and a willingness to be flexible, and practice
  trusting your intuition.
2. During each coaching session, whether it's one-on-one or in a group, Erika
  Walton will provide support to the best of her ability using a variety of tools,
  such as weekly coaching modules, intuition, meditation, communication
  techniques, Ayurveda, astrology, Feng Shui, and more. Your role is to receive the
  information, digest it, and practice implementing it. If a suggestion doesn't
  resonate with you, it's okay to trust your intuition and communicate that
  respectfully.
3. We do not tolerate disrespectful behavior towards Erika Walton, assistant
  coaches, assistants, or other clients. If you become difficult, aggressive,
  unteachable, uncoachable, unwilling, inflexible, or any other way that
  negatively impacts the group, you will receive two warnings before being
  removed from the coaching master class Destiny by Design, with no refunds.
  No exceptions. Note that this policy applies to one-on-one and group coaching,
  and that all group coaching sessions are set and cannot be rescheduled for
  individual clients.
4. During each weekly coaching session, it is important that you take
  responsibility for the language you use to describe your life experiences, as this
  has a direct impact on your reality. Erika Walton will do her best to support
  each person in the course, but please keep in mind that her coaching style is
  designed to trigger and evoke reactions related to your wounds. It is your
  responsibility to be willing to work through any traumas in your life without
  blaming or disrespecting anyone in the course or Erika Walton. People will be
  sharing a wide range of experiences, from small hurts to intense experiences
  such as depression, anxiety, sexual orientation, dismorphia, health issues,
  demons or dark energy, suicidal thoughts and actions, racism, physical violence,
  assault, molestation, rape, stealing, murder, death, and more. This is a safe place
  to share your vulnerabilities and express yourself freely, but you must be
  willing to be coached. You may encounter different perspectives and cultural
  beliefs that challenge your current beliefs. The intention is to help your
  consciousness grow and evolve. Any strongholds such as identity, sexual beliefs
  of identity, political attachment, current cultural propaganda, etc., will also be
  challenged and encouraged to be left at the door, so that you can grow beyond
  them. One of the foundational principles of Erika Walton's coaching and
  Destiny by Design lessons is to help you remove all "false identities appearing
  real" and return to your core of who you truly are.
5. All coaching and suggestions provided during one-on-one or group coaching
  sessions are solely your responsibility on how you react, think, believe, and take
  action. Erika Walton and Destiny by Design are not responsible for any
  outcome or consequence resulting from the coaching. The master class and
  coaching are designed to empower you to take full responsibility for your life.
  You release all liability and responsibility of Erika Walton, and business Destiny
  by Design master class/coaching, for any of your actions, thoughts, beliefs, and
  decisions made during or after the coaching sessions.
6. All coaching and suggestions shared during one-on-one or group coaching
  sessions are solely for informational and educational purposes. It is your
  responsibility to choose how you react, think, believe, and take action based on
  the information provided. Erika Walton and Destiny by Design do not assume
  any responsibility or liability for your actions, thoughts, beliefs, or decisions
  based on the coaching received. By participating in the coaching master class,
  you acknowledge that you are fully responsible for your life and all of your
  choices. Therefore, any actions you take are entirely at your own risk.
7. All communications shared during coaching sessions, whether one-on-one
  or group, are strictly confidential and may not be shared with anyone without
  explicit permission from the individual who shared the information. This
  includes sharing on social media or with other individuals who are not part of
  the coaching program. We respect and protect your privacy and expect you to
  do the same for others. Any breach of confidentiality will not be tolerated and
  may result in immediate termination from the program, without refund, and
  legal action may be taken if deemed necessary.
You agree to indemnify and hold the Company and each of its directors, officers
employees, and agents, harmless from any and all liabilities, claims, damages and
expenses, including reasonable attorney’s fees, arising out of or relating to (i) your
breach of this Agreement, (ii) any violation by you of law or the rights of any third
party, (iii) any materials, information, works and/or other content of whatever nature
or media that you post or share on or through the Site, (iv) your use of the Site or any
services that the Company may provide via the Site, and (v) your conduct in
connection with the Site or the services or with other users of the Site or the services.
The Company reserves the right to assume the exclusive defense of any claim for
which we are entitled to indemnification under this Section. In such event, you shall
provide the Company with such cooperation as is reasonably requested by the
Company.
If you send comments or suggestions about the Site to the Company, including, but
not limited to, notes, text, drawings, images, designs or computer programs, such
submissions shall become, and shall remain, the sole property of the Company. No
submission shall be subject to any obligation of confidence on the part of the
Company. The Company shall exclusively own all rights to (including intellectual
property rights thereto), and shall be entitled to unrestricted use, publication, and
dissemination as to all such submissions for any purpose, commercial or otherwise
without any acknowledgment or compensation to you.
When you register with the Company and/or this Site, you expressly consent to
receive any notices, announcements, agreements, disclosures, reports, documents,
communications concerning new products or services, or other records or
correspondence from the Company. You consent to receive notices electronically by
way of transmitting the notice to you by email.
1. The Company shall use commercially reasonable efforts to restrict
  unauthorized access to our data and files. However no system whether or not
  password protected can be entirely impenetrable. You acknowledge that it may
  be possible for an unauthorized third party to access, view, copy, modify, or
  distribute the data and files you store using the Site. Use of the Site is
  completely at your own risk.
This agreement shall be governed by and construed in accordance with the laws of
the State of California, without giving effect to any principles of conflicts of law. You
further submit to the exclusive jurisdiction of the state and federal courts sitting in
Santa Cruz County, California. If any provision of this agreement shall be unlawful,
void, or for any reason unenforceable, then that provision shall be deemed severable
from this agreement and shall not affect the validity and enforceability of any
remaining provisions.
These Terms of Use may be revised from time to time by updating this posting. You
are bound by any such revisions and should therefore periodically visit this page to
review the then current Terms of Use to which you are bound.

By participating in this Destiny by Design master class and coaching, you agree and
acknowledge that you have read, understand and fully agree to the above disclaimer and you are now a Private Member under this Private Contract.
